How to Mutually Terminate a Lease

The repercussions of terminating a lease before the term ends include owing your landlord back rent and dealing with a possible credit judgment. Some landlords are sympathetic to economic or personal issues. If you encounter a situation that warrants early termination, your landlord may mutually agree to release you from the lease, and not take legal action.

    Type a letter explaining that you plan on terminating your lease early due to unforeseen situations. Highlight the reason and provide the date that you plan on terminating the lease. State your willingness to strike a deal with your landlord in order to avoid credit and legal consequences. Give your landlord at least 30 days notice.

    Pay the required fee to get out of the lease. Convince your landlord to let you out of the lease without penalty by offering to pay the outstanding balance on your lease agreement. For example, if you have two months left on your agreement, give the landlord two months rent to fulfill your commitment.

    Seek out another tenant to take over your monthly obligation. Your landlord likely relies on rental income, and might agree to mutual termination of the lease if there's someone waiting to move in. Join forces and work with your landlord to find a new person for the rental. Talk to coworkers, friends, relatives and other acquaintances to see if they're interested in taking over your lease.

    Obtain written confirmation of the agreement from your landlord. Once you and your landlord reach a mutual agreement for termination of your lease, get this agreement in writing. Keep a copy of this agreement in case your landlord reneges and decides to take legal action for breach of contract.
