Who Can Apply for Section 8 Housing

The Section 8 housing program was established by the Housing and Community Development Act of 1974 to provide housing rental subsidies to individuals and families in need of affordable, quality housing. The program is operated nationwide and usually experiences high demand. Families in need are encouraged to get on a waiting list as soon as possible, since long waiting periods are common.

The Voucher Program

    Section 8 housing subsidies are provided mostly through the housing choice voucher program. The housing choice voucher program, funded by the federal government, helps low-income families and individuals afford safe, sanitary and decent housing. The housing choice voucher provides a rent subsidy on behalf of individuals or families, allowing them to choose their own single-family home, apartment or townhouse in the private market. Participants in the program do not need to live in subsidized housing projects and can choose any housing that meets the program's requirements.

Public Housing Agencies

    Housing choice vouchers are managed at the local level by PHAs, or public housing agencies. Federal funds from the U.S. Department of Housing and Urban Development (HUD) are provided to the PHAs to operate the program. Individuals or families are issued a housing choice voucher and then locate their own choice of housing with an owner or landlord who will agree to rent to them under the subsidy program. The chosen housing may be the current residence of the family. Any rental unit is subject to minimum health and safety standards as set forth by the local PHA.

    A subsidy for the housing is paid directly from the PHA to the landlord on behalf of the individual or family. The participants then pay the amount of rent that is not covered by the subsidy. In certain circumstances, a family may apply its housing choice voucher to a modest home purchase, depending on authorization from the PHA.

Who Can Apply?

    Low-income families and individuals, the elderly, disabled and veterans may apply for the program. The PHA determines eligibility based on family size and annual gross income. The program is available to US citizens and certain noncitizens with an eligible immigration status. Generally, to qualify for assistance a family may not have income higher than 50 percent of median incomes for the metropolitan area or county. The law dictates that a PHA needs to provide 75 percent of all its vouchers to applicants with incomes that are 30 percent or less than the median income for the area. The HUD publishes median income levels, which vary by location. Each community's PHA can provide interested families with the required income limits for the area based on the number of family members.

Special Preference

    Certain individuals or families may receive special preference during the selection process to receive a housing choice voucher. These preferences vary based on the location of the PHA. For example, preference may be given to any family or individual residing in a private or public care facility due to severe disability or illness, if they could transition back into their community to live with the assistance of an aide or on their own. Any spouse or head of a family in the military, or a veteran or veteran's surviving spouse may receive preference as well. Additionally, families with a member who is disabled or age 62 or older, or an applicant or family residing in a private or public shelter due to domestic violence may receive preference.

Subsidy Amount

    The PHA will calculate the highest level of allowed housing assistance for recipients. This is usually either a standardized rent payment minus 30 percent of a families' adjusted monthly income, or a housing unit's gross rent minus 30 percent of adjusted monthly income, whichever is less.
