How to Evict a Room Mate

An unpleasant fact of life is that, if you accept a roommate, you must be prepared to evict that roommate in the event that your roommate does not pay the rent, or engages in unacceptable behavior. Some simply throw the roommate's belongings into the street and change the locks on the property, but this can create all sorts of problems and may not be legal. Instead, have a legally binding, signed and witnessed roommate agreement in place, preferably before the roommate moves in. However, you can create such a document at any time.

    Build conditions into the roommate agreement. Specify the amount of rent, when it must be paid, and what privileges the roommate has - for example, cooking, backyard privileges, overnight visitors, parties. Most importantly, specify what conditions would trigger eviction, such as being behind in the rent by so many weeks or months, being arrested, being repeatedly intoxicated, and how many incidents trigger eviction. Write this according to the wording suggested in your book on writing a legal rental agreement in your jurisdiction.

    Issue receipts for payment of rent. This comes in very useful in case of a dispute regarding rent payment. You have a right to insist that the roommate produce a receipt for rent that the roommate claims was paid.

    Keep careful records. Record when rent was received, how much was paid, and whether it was in cash, a check, or in trade. Record instances of objectionable behavior, with date and details.

    Give appropriate notice in writing. For example, give notice when rent is late, or when objectionable behavior occurs. Quote the language in the roommate agreement regarding the circumstances under which eviction will occur.

    If necessary, give a final notice of eviction. State the reasons and quote the roommate agreement.

    Take your documentation and obtain the help of the local police department or marshal's office. There may be a fee to have an officer conduct an eviction.
