When Can a Month-to-Month Lease Be Terminated in Pennsylvania?
Unlike traditional leases, month-to-month leases last for thirty days. Typically, at the end of the month, the tenant can move out of the rental property, or the lease renews automatically. Pennsylvania landlord-tenant laws allow tenants to move out within a certain period on a month-to-month lease. The laws also govern the time for returning security deposits.
Time Frame
Under Pennsylvania law, a tenant can move out at the end of his lease without giving the landlord a written warning. The lease term on a month-to-month lease typically lasts from the first day of the month to the last day of the month. A tenant can move out on the last day of the month. A tenant can also move out if the landlord fails to make necessary repairs, such as fixing a major plumbing leak.
Notice
While it is not required, a tenant should provide the landlord with a written notice several days in advance. A written notice will help keep a good relationship between the tenant and the landlord. If the tenant plans to move because the landlord failed to make repairs, he should include a detailed description of the repairs in the notice. Moving Out
The tenant must have all of his personal belongings out of the rental unit by the scheduled move date, or the last day of the month for month to month leases. The tenant should clean the rental unit after moving out. If the tenant made any changes to the property, such as painting the walls or adding curtains, she should replace the property to its original condition. The tenant should also schedule a time to meet with the landlord to return the keys to the property.
Security Deposits
Tenant.net reports that Pennsylvania landlords must return the security deposit to the tenant within 30 days of the tenant's moving out. The landlord can take deductions from the deposit if the tenant failed to pay his last month's rent, made any damages to the rental or did not clean after moving out. The landlord must make an itemized list of any deductions and mail the list with any remaining security deposit to the landlord.
