Rules for Landlord Replacement of Carpet & Rentable Condition
As a renter, you have the benefit of not being responsible for making repairs to the property. However, this does not mean that the landlord must meet every repair request you make. State landlord and tenant laws only require that a landlord repair so much. Damages to your carpet typically do not fall under these requirements, but the landlord may have to repair the carpet any way, depending on your lease.
Landlord's Obligation to Repair
Your landlord must abide by the landlord and tenant laws in your state. Most states require that the landlord make any repairs that put your health and safety at risk, such as repairing a broken lock on your front door. Most state laws also require that your landlord keep the property in rentable condition, meaning the landlord will have to repair any damage that makes the property unlivable. However, the law may not require that your landlord make other repairs, such as replacing damaged or stained carpeting.
Repairs and the Lease
While the landlord and tenant laws may not specifically state that the landlord has to repair minor issues such as carpeting, most laws require that the landlord abides by the terms of the lease agreement. If your landlord promised to make any requested repairs in the lease agreement, he must repair or replace your carpeting. If the landlord refuses to make the repairs, you may have the option to repair the damage yourself and deduct the cost from your rent or seek civil action against your landlord, depending on your state's landlord and tenant laws.
Repairs Before You Move In
If your landlord makes any promises to repair or replace damages in a rental unit before you move in, you must get those agreements in writing. For example, if your landlord says he will replace the carpet in your bedroom, request a written agreement. The landlord must honor any written promises, and you may have the right to sue your landlord in a civil court if he does not make the repairs.

The actions you can take as a tenant vary by state. Read your lease agreement and the landlord and tenant laws in your state before taking action against your landlord. While some states allow you to deduct the cost of repairs from the rent or invoice your landlord, other states do not have any provisions for nonessential repairs.
