Requirements for Lessors and Lessees
With a rental property, the tenant and landlord must meet certain requirements regarding items such as as rent, property upkeep, courteousness, notices, fairness and entry and privacy. These responsibilities are designed to keep the tenant safe. They also protect the landlord's property. Usually, these requirements are outlined in the lease. However, even when not detailed in individual leases, the obligations appear in local, state or federal regulations. Lessors and lessees must fulfill their obligations or face potential legal trouble.
Rent
Lessees are required to pay lessors the amount of rent indicated in their leases on time. Failure to do this may result in lessors charging late fees or starting eviction proceedings for nonpayment of rent. Additionally, lessors are required to keep rents charged static throughout the duration of the leases, unless the lessees are on a month-to-month agreement. Even when a month-to-month agreement is in place, lessors must provide notice to the lessees of any rent increase.
Property Upkeep
Lessors must provide lessees with a clean, safe rental unit when the lessees move in. They also must maintain the property and respond to requests for repairs. Conversely, lessees must report any problems with the property so the issues do not worsen and cause injury or increased property damage. Lessees must keep rental units in the same or better condition than when it was rented and cannot make changes to the units without their lessor's permission.
Courteousness
Lessees must conduct themselves courteously while renting properties. This means refraining from loud music or other noise or engaging in behavior that could put others at risk. Lessees are responsible for their guests. At the same time, lessees have a right to a peaceful, quiet environment, so lessors must address noise and behavior violations from other tenants.
Notices
Both lessors and lessees must provide written notices to each other regarding their intent. This sometimes is a courtesy, but in some cases, such as with vacating units, it is a legal requirement. Lessors should provide notices for items such as late or modified rent, inspections, showings, repairs and intent to evict. Lessees should provide notice for vacating, extended absence from the rental property and maintenance needs.
Fairness
Lessors should not practice discrimination, either in renting or addressing issues with the rental properties. Unless the property is specifically zoned for specific individuals, such as seniors over age 55, lessors cannot refuse to rent based on factors such as sex, marital status or ethnicity.
Entry and Privacy
Lessors have the right to enter their rental properties, but only under limited circumstances. For instance, they may enter the properties to make repairs or to show the properties to new prospective renters. However, lessees have the right to privacy. Lessors may not enter rental properties without notice in most cases, unless there is an immediate safety threat or the lessors have reason to believe the lessees have abandoned the properties.
