RCW 59.18 of the Landlord-Tenant Act in Washington State
The Washington Residential Landlord-Tenant Act is codified in Title 59, Chapter 59.13 of the Washington Revised Code. The act covers all residential rentals between landlords and tenants except for mobile home tenancies. The Washington Mobile Home Landlord-Tenant Act governs mobile home rentals within the state. Landlords have duties to provide necessary repairs within 24 hours after receiving notification from their tenants of problems with their water, electricity or heating, and 72 hours for appliance and plumbing fixture defects.
Lease and Tenancy Types
The Washington Residential Landlord-Tenant Act allows landlords and their tenants to enter into periodic tenancies or tenancies for specified terms. They may enter into written or oral lease agreements. Periodic tenancies are typically for month-to-month or week-to-week terms. Periodic tenancies are automatically renewed without written notice from one party at least 20 days before the last day of the month. Specified tenancies allow the parties to enter into an agreement for specified terms, typically for at least one year.
Security Deposits
Landlords can require their tenants to provide them with a security deposit to cover damages, but they must be refundable. The Washington Residential Landlord-Tenant Act requires landlords to enter into written lease agreements with their tenants if they charge them nonrefundable fees or collect refundable security deposits. Landlords are obligated to provide their tenants with a written document recording the condition of the apartment prior to tenancy, and they also must place their tenants' deposits into separate trust accounts. Landlords must provide their tenants with a written receipt, name and address of the bank where their money is being held. Washington law, different from many other jurisdictions, allows landlords to keep any interest earned on their tenants' deposits. Landlords have two weeks to return their tenants' security deposit after moving out and must itemize damages and charges in writing.
Increasing Rent
Generally, Washington law does not allow either party in a tenancy for a specified term to change the terms of their agreements without obtaining consent from the other party. For periodic tenants, landlords can increase their rent unless they specifically agreed not to increase their rent during the term of their tenancy. The landlord-tenant act allows landlords who did not agree to be bound by any rent charge to increase rent after providing their tenants with at least 30 days of written notice of the rent increase.
Terminations
Landlords are generally prohibited from evicting their tenants before the end of their lease terms if they signed specified-term agreements. However, landlords can evict their tenants if they breached their lease by not paying rent or violating the terms of their agreements. For periodic tenancies, landlords can freely evict their tenants for legal reasons with at least 20 days' written notice before the last day of the month. Tenants also may terminate their tenancies by providing 20 days written notice.
