My Lease Is Up: How Soon Can I Move if I Have Section 8?

The Section 8 portability option allows tenants to transfer their housing subsidy to a new unit. The process requires the completion of several steps and impeccable timing. Housing authorities across the nation adhere to varying policies, but federal government regulations require the completion of several basic steps. The timing involved depends on several factors, such as housing authority case load and housing availability.

Housing Assistance Payment Contract

    Tenants moving to a new Housing Choice Voucher unit must initiate a request for a new housing assistance payment contract. Typically, tenants complete a process similar to the annual re-certification, which requires the provision of family composition, income and resource documentation. Tenants also must provide proof that they submitted a vacate notice and that the utilities and rent were paid in full. If the tenant declines to continue receiving the subsidy, she must notify the housing authority and can move at any time. If she wishes to continue receiving assistance, the housing authority sends an appointment letter, which can take two weeks to 30 days.

New Voucher

    Once the tenant initiates the request for a new housing assistance payment contract, she must meet with her case manager to conduct and interview and receive a new Housing Choice Voucher. The interview provides the housing authority the opportunity to ask for substantiation of income or other documents. The case manager will review the tenant's documentation and issue a new voucher. The new voucher provides 30 to 60 days, depending on the housing authority's policies, to search for new housing and initiate an inspection.

Inspection

    When the tenant locates a new home, her new landlord must submit a request for tenancy approval to the appropriate housing authority. It will schedule an inspection, which can take up to three weeks to complete. If the new home passes the inspection, the housing authority will determine a tenancy date. If the new home fails inspection, the landlord has up to 30 days to repair or improve the unit and the housing authority will schedule a followup inspection, which can take an additional three weeks.

Contract

    The housing authority's administrator will execute the contract once the inspection process is complete. The tenant cannot move into the new unit until the landlord, housing authority and tenant execute the lease and contract. This process can take several days after the completion of the inspection. Depending on the housing authority's policies, the tenant may not be able to move into the unit until the first day of the following month. The entire process can take 30 to 90 days.
