Tenant Documents to Collect Before Renting When Renting a House

As a landlord, you have to go through a screening and approval process before you can accept a new tenant. Otherwise, you risk damage to your property and your business. You should request an application, lease agreement and move-in checklist from every new tenant. You may also have to request a tenant's signature on other documents, such as a lead disclosure agreement, depending on the age of your property and the landlord and tenant laws in your state.

Application

    Request an application for tenancy from every new tenant. This includes primary renters, roommates and any adult who will live with the tenant. An application includes the tenant's personal information, income level, current employment and previous rental history. If you plan to run a credit or background check, have the tenant sign a waiver allowing you to do so. Get copies of the tenant's personal identification, such as his driver's license or state-issued identification card.

Lease Agreement

    Create a written lease agreement for every new tenant. The lease agreement must include the length of tenancy, the full names of any tenants, the amount of rent and security deposit, and any rules you have for the property. It should also clearly define what maintenance you will perform. You may also include other clauses in your lease agreement, such as a pet policy. If you allow pets, you may want to include a separate signed agreement that lists a pet deposit amount.

Move-In Checklist

    A move-in checklist gives the new tenant an opportunity to make a note of any pre-existing damage. Most move-in checklists list the areas of the property, such as the kitchen, bedroom and bathroom, and leave blank space for the tenant to note any damages. Request that a new tenant fill out this form and provide you with a copy as soon as the tenant moves in. With a move-in checklist, the tenant can not blame new damages on a pre-existing condition.

Other Documents

    Depending on your property and your location, you may need to collect other signed documents from a new tenant. For example, if your rental property could contain lead paint, ask your tenant to sign a lead disclosure notice. Providing this notice to your tenant informs him of the dangers associated with lead paint. You can also request that the tenant sign a property rules agreement. However, make sure any rules you put on the agreement do not violate the landlord and tenant laws in your state.
