Do I Keep a Key When Renting My Home?
Some tenants object to their landlords using keys to their dwelling, although this is quite a common practice. As a property owner, you have the right to keep a rental home key even though a tenant occupies the house. In fact, a renter who decides to change the locks is obligated to provide you with a new key. Tenants and landlords both benefit from the landlord's key in some situations.
Tenant Lock Out
Your tenant may lock the house keys inside the home on any given day. This may be the first time your renter appreciates the fact that you have a key to the house. Certainly, tenants do not object to landlords using keys to help them gain access to their homes at such times. It saves the tenant from paying the cost of a locksmith or the cost of damages for breaking into the home.
Repairs
Most states require landlords to maintain the working order of rental properties. That includes everything from the heater to toilet flappers. In many cases, you will choose to make the repairs or bring a qualified service contractor to your home for the tenant. Follow the state regulations for 24 or 48 hours notice to a tenant before coming to the home. Bring the landlord's key and use it if the tenant is not at home.
Inspections
Most states stipulate the rights of property owners to conduct inspections of homes during the course of a lease. These laws allow landlords to come into the home and check for damages, cleanliness and proper use of the premises as agreed under lease terms. You must give your tenant proper notice before coming to the home for an inspection, but you are allowed to use your rental home key to gain entry if necessary.
Tenant liens
Some states allow landlords to hold a lien against a tenant who owes money. In such cases, you may take and hold certain possessions from your rental house to encourage the tenant to pay the debt. You may also use the landlord's key to enter the home to claim such property if the tenant does not freely grant you access. Courts often allow landlords to sell such property after 30 days of non-payment.
