Tips on Questions You Should Ask When Starting to Rent a Home

Before renting a home, become familiar with your state's rental laws and understand your rights regarding security deposits and evictions. State laws vary, and if you have moved from one state to another, you may discover what was legal in your previous state is not allowed under the laws in the state in which you now reside. The rental agreement answers many of the questions you need to ask. Read the rental agreement carefully, and if you can't find the answer to your question, ask the property manager or owner before signing the agreement.

Foreclosure or Short Sale

    Before renting property, ask the property manager if the property is in foreclosure or listed in a short sale. Avoid renting such a property, unless you don't mind moving before the end of your rental agreement.

Length of Rental Contract

    Ask how long the rental agreement is for and what happens when it ends. Typically, a rental agreement guarantees a specific rent amount during the term of the lease and prevents the property manager from evicting you from the property, providing you don't violate the terms of the rental agreement. When the lease expires, it may revert to a month-to-month lease, giving the landlord the option to raise the rent or evict you.

Deposits

    Find out what happens to your deposits. The landlord or property manager may require you to provide a security deposit, cleaning deposit or pet deposit. Some deposits are nonrefundable. Find out what conditions constitutes a nonrefundable deposit and check your state's laws to verify the property manager is within his rights to keep a deposit under conditions indicated by the property manager.

Moving Notice

    Ask about the procedure for giving a moving notice. In some situations, if you fail to give proper notice, the property manager has the right to keep your deposit. Even if you are on a month-to-month agreement, it is common for rental agreement to require you give a 30 days' or other number of days' notice.

Parking Rules

    If you have a car or other vehicle, you need to know where you are able to part the vehicle. Identify guest and overnight parking areas. There may be an additional rental fee for a parking space.

Tenant Checklist

    Ask the property owner if you will be required to complete a tenant checklist before you move in. If not, ask for one, as a tenant checklist protects the tenant as much as it does the property owner. The checklist verifies the condition of the property at the time you moved in and is signed by all parties.

Emergency and Repairs

    Find out where to send your rent payment and to whom to make the payment. Ask for a list of emergency contact phone numbers. You need to know who to call in the middle of the night if a pipe breaks or the air conditioning unit breaks down.

Rules and Regulations

    Request a list of the property owner's rules and regulations to determine if you are able to live by the rules. These rules typically cover pets and guests on the property and other use of the property.
