Renters' Termination Etiquette Without a Lease
Just because you do not have a lease does not mean you do not have to notify your landlord before you move out. Giving your landlord proper notice will help keep your relationship with the landlord on a positive note, which may mean a glowing reference for you in the future. When you decide to give your notice, do so in writing and give the landlord plenty of advanced warning.
Time Frame
Even without a lease, you should give your landlord adequate notice that you plan to vacate the rental unit. Most states have included a time frame for notifying the landlord of your intent to vacate on a month-to-month lease in the state's Landlord and Tenant Act. Typically, you must notify the landlord at least 30 days prior to your move date. For example, if you plan to move out by the end of May, you should notify your landlord by the 30th of April.
Notice
Write a formal letter to your landlord telling him of your plans to move. You do not need to go into a lengthy explanation, but you should include the date you plan to leave the property. You can send the letter through certified mail or deliver it to your landlord in person. Keep the lines of communication open between you and your landlord. If you have to change your move date, let the landlord know ahead of time. Staying in touch with your landlord will help keep your relationship positive.
Follow Up
Before you move out, clean the property as well as you can. This will help you get your full security deposit back from the landlord. As soon as you move out, you will need to return your keys to the landlord. If you can, request that the landlord meet you in person to deliver the keys. You can also use this time to complete a final walkthrough inspection with the landlord. If you cannot meet the landlord in person, drop off the keys in a safe place and immediately notify the landlord that you have done so.
Considerations
You will still need to pay for the final month of rent, even if you move out before the end of the month. If you do not pay your rent, the landlord can withhold the amount from your security deposit. Keep a copy of any documents you send to the landlord. If the landlord fails to return your security deposit, you may need this information to help prove your case in court.
