Pros of Rent Stabilization
Rent stabilization was initiated in many cities in the 1960s to prevent landlords from capitalizing on demand and hiking rents up unreasonably, or evicting tenants to bring in higher-paying tenants. Apartments under rent stabilization were generally built during a certain period and meet certain criteria. Some buildings become rent-stabiliized because they get tax breaks and because of that they must abide by rules that protect tenants' rights.
Rents Don't Skyrocket
With rent-stabilized apartments, rents can only rise by a certain, controlled percentage at the end of each lease period. Landlords can not jack prices up to whatever amount they feel they can get because of increased demand or improvement in the area. In New York City, for example, rent-stabilized apartment increases are determined by the NYC Rent Guidelines Board, which considers economic condition of the real estate industry including utilities and current and projected cost-of-living indexes.
You Can Release
Apartments under rent stabilization must offer the tenant the chance to re-lease, rather than evicting one tenant and bringing in another at a higher rate. There are exceptions; for example, if the landlord intends to use the apartment for his own family. But for the most part, it means those renting stabilized apartments will not have to search for and move to another apartment unless they choose to.
You Must Be Compensated
Under rent stabilization, if you are evicted from an apartment because the owner intends to demolish it for a new building, the owner must offer you compensation, either paying your moving and other relocation costs or giving you the cash equivalent. This rule is not necessarily applied for apartments that are not rent-stablilized.
Landlord is Accountable
With rent stabilization, the landlord is accountable to a public housing authority when it comes to making building renovations, hiking rent, evictions or other actions affecting a tenant. So tenants have someplace they can go to find out what the rules are precisely and what they can do to protest adverse actions by a landlord. This is better than with apartments that are not rent-controlled where tenants have no clear place to make complaints.
