Maryland Requirements to Break a Lease

By signing a lease, you agree to live at a property for a certain amount of time and pay the rent each month. If you need to move out of a property during the lease term, you will have to pay the landlord in order to do so. Maryland law sets a limit to how much a landlord can charge to let you out of your lease, but some landlords may charge much less.

Notification

    When you plan to end your lease, even if doing so mid-term, you must notify your landlord in writing. If you end your lease at the end of the term, you must notify your landlord within the time frame specified in the lease agreement. You can find this information under the termination clause. If you leave your rental during your lease, you should notify your landlord as soon as possible. You do not have to give a reason for terminating your lease.

Fees

    Under law, the landlord can require you to pay for the remainder of the rent due if you end your lease early. However, the landlord must make an honest attempt to rent the unit to a new tenant. If the landlord finds a suitable tenant, you only need to pay for the time the property sat vacant.

    Some landlords have different rules regarding the fees for an early termination. For example, your landlord may require that you pay one lump sum to end your lease, not the total rent due. Check your lease for specific fee details.

Moving Out

    The landlord can still hold you responsible for damages and cleaning fees if you break your lease early. Before you move out, clean thoroughly and return the unit to its original condition. For example, if you painted your bedroom walls you will need to repaint them back to their original color. If you cause any damages or leave the property unclean, the landlord can deduct this from your security deposit or sue you in small claims court.

Considerations

    Your landlord can only charge you for the remainder of the rent, or an alternate fee if stated in the lease. If the landlord charges you a higher fee, you can take action against him in a local court. The landlord cannot withhold your security deposit. If you pay out the remainder of your lease, the landlord can only deduct the cost of repairs or cleaning from your security deposit.
