What Can a Landlord Do if a Tenant Doesn't Pay?

Landlords and tenants each have legal rights that help determine apartment rent limitations, extra charges and late procedures. Sometimes tenants fall on bad times and do not pay a landlord rent. Although the laws and regulations change depending on where the apartment or home is located, there are a few rights landlords have if a tenant does not pay rent.

The Right to Give the Tenant a Notice

    When a tenant doesnt pay rent on the agreed-upon date, the landlord has the right to give the tenant a notice of rent due. Depending on the laws of the local government, the notice can be issued any day after the rent is considered late. This notice for nonpayment of rent must include the amount of rent owed, the date the tenant is to move if he does not pay and a statement that says the tenant can disagree with the landlord's notice. If the tenant disagrees with the notice, it is the tenant's responsibility to sort out the discrepancy in court.

The Right to Take the Tenant to Court

    The landlord has the right to take the tenant to court if he does not move or pay the rent by the date in the nonpayment notice. Once the tenant is taken to court, the tenant now has the option of paying, working out a payment plan or being ordered legally to leave the premises. If the tenant is taken to court by a landlord, the landlord can seek to have the tenant legally evicted from the premises.

The Right to Have the Tenant Removed From the Property

    If a tenant does not pay the rent, is given the eviction notice and does not leave the property, the landlord has the right to call the local police department and have the tenant removed from the property. The local police department enters the home and removes the tenant. Afterward, it is the landlords responsibility to change locks, clean the home and repair any damage caused by the tenant.

The Right to Report the Tenant to the Credit Bureau

    The landlord has the right to contact the three credit bureaus when a tenant doesn't pay rent, adding the delinquency to the tenants credit report.
