The Signature Requirements Needed by Law on a Texas Rental Agreement

Signing a contract is a legally binding act. A rental lease is a contract agreement that is a legal document. In Texas, signing a lease means that you agree to, and will follow, all of the provisions contained in it. However, in Texas, not all occupants in a rental unit are legally bound to sign the agreement; but, for those who are, there are consequences for not following through with any of the provisions.

Applicants

    The Texas Association of Realtors requires all intended occupants, 18 years of age or older, to submit a completed and signed application for tenancy. Even if the adult is a dependent of yours, an application must be returned with the fee. If background checks are being performed, each applicant will be subject to one. Many landlords check a person's income, credit history and rating, employment, prior addresses and evictions. It's also possible that a criminal history will be requested on all applicants, too.

Signatures

    Each approved occupant 18 years of age or older is required to sign a lease agreement. Texas Property Code Section 94.053 stipulates that a lease agreement must be signed by the landlord and the tenant. Since all household adults must apply for tenancy, each also must sign the lease. If another adult later requests to permanently move into the household, then that person must complete an application, be approved by the landlord and sign a revised lease before occupancy can occur.

Considerations

    If you are a tenant in Texas and your adult son is obligated to sign your lease, he will be responsible for paying the rent in full if you are not able. All adult signers are each independently responsible for the entire rent. Therefore, if your roommates cannot pay their portions of the rent, for example, and you pay your share, all of you can be evicted and have your credit ratings impacted, even though you were holding up your end of the agreement.
