How to Transfer a Rental Lease to Another Property
Pipes fail, trees fall on buildings, wires short out and cause fires and other accidents happen that cause buildings to become unlivable. These situations pose unique problems for owners and tenants of rental property. A lease binds the tenant, landlord and property together for a set amount of time. An accident that causes major damage makes it impossible for that situation to remain the same. One answer to this problem is for the tenant to move into a new piece of property while remaining bound to his original lease. Owners and tenants alike can suggest this situation.
Instructions
As a Landlord

Review every piece of correspondence you receive from your tenant. Review and act on every complaint she sends to you.
2Work with the tenant to remedy the situation. Do not ignore a hazardous situation on your property. Contact a professional for repairs if necessary.
3Find another unit in your possession for the tenant to occupy if her's is uninhabitable. Choose a unit that is comparable to the one she previously occupied.
4Notify the tenant of the change. Go inspect the new unit with her and get her approval before proceeding.
5Draft a new lease for the tenant. Include the same stipulations and end date for the new address as it was written on the old lease.
As a Renter

Notify the landlord of damage or defects that make the property unlivable via telephone. Request an immediate remedy by a qualified contractor.
7Meet the contractor at your home at the time of the scheduled appointment. Allow him to do his job without interference. Talk with him to get a summary of the damage. Ask him to write his assessment of the unsolved problem on a piece of paper and sign it.
8Write a letter to your landlord reiterating the problems at the property. Request as new place to live as your current residence is unlivable. Add a copy of the contractor's summary. Send both documents to your landlord via certified mail.
9Meet with your landlord to view new properties. Choose one that is comparable to your current residence in size and price. Sign the lease provided by your landlord with the new address and end date.
10Move your belongings into your new home as quickly as possible. Clean your old residence and leave it as nice as it was when you moved in at the beginning of your lease.
