How to Make a Lease for Rent

Renting your house or apartment to another person without creating a lease agreement is a welcome mat for problems. Without a lease agreement, you can't legally enforce issues that can arise such as breach of contract for early termination. A lease agreement establishes boundaries and outlines specific terms.

Instructions

Get the name of each tenant residing in the apartment or house. Having each adult living in the apartment on the lease agreement protects you if one party stops making the payment. You can sue the other adults on the agreement for back payments if they terminate early.

Specify who's allowed to live in the apartment or house. With a signed lease agreement, you can limit the number of people who occupy your rental. You can also require tenants to notify you if someone new moves into the unit.

Include a section highlighting the lease term. Without specifying the term of the rental lease, your tenant can move whenever he wants. Write the date of commencement for the rental agreement and the date that the term ends. If you allow month-to-month leases, include information on how much notice to give if the tenant plans to vacate the property.

Discuss the financial aspect. Include information on the monthly rent, security deposit, late fees and return-check fees. State whether security deposits are refundable upon completion of the rental lease.

Address other issues with renting the apartment. State your rights for entering the property. In other words, does signing the agreement give you permission to enter the apartment without notice. Will you allow pets in the unit? Does the rental payment include the costs of utilities? What type of maintenance and repairs will you provide?
