How to Break a Lease in Maryland Due to Medical Reasons

In the state of Maryland, no law is in place that allows you to break a lease for medical reasons. Unless the landlord is violating state or federal law, you should expect to pay for any remaining months on a lease if you break your agreement with your landlord. In many cases, however, a landlord may be sympathetic to your individual situation. This is particularly likely if you have a strong rental history of timely payments and little to no issues concerning the rental unit.

    Read over your lease thoroughly and look for any clause that may apply to your situation or could apply to breaking a lease, such as a code violation or legal issue.

    Ask your landlord to let you out of your lease. This is the simplest way to get out of your lease. Explain your situation honestly to your landlord and offer to help find a new tenant, if possible.

    Offer to sublet your home until the end of the lease. This is a common option especially among those who are only living in an area temporarily. Your lease will outline if your landlord allows subletting or you can get permission directly from your landlord in writing.

    Leave the home and fight the matter in court. If you break your lease and fail to pay for the remaining months, your landlord can take you to small claims court to recoup the damages. Since a lease is a contract, it is unlikely you will win, despite a severe medical condition. The judge may be lenient, however, and only make you liable for the amount the landlord lost in rental payments until he found another tenant instead of the full remainder of your lease.

    Ask if there is another apartment or home available by the landlord that you can rent under the Fair Housing Act. For example, if your medical condition prevents you from climbing stairs, you can make a claim under the Fair Housing Act for a new place to live. If the landlord is unable to provide reasonable accommodation for you, such as a ramp to your current apartment, you may be able to cancel the lease.

    Contact a lawyer or Legal Aid. Your local Legal Aid office has experience in landlord-tenant matters and may be able to help you find a way to vacate your lease legally and still cope with your medical condition.
