How to Break a Lease Agreement Right After Renewing in Florida

A fixed-term lease requires you to rent your unit until the end of the term as stated in the agreement. When the term runs out, you and your landlord can renew the lease by signing another fixed-term lease. Breaking a lease agreement in Florida may result in monetary penalty. According to Florida laws, you may have to pay rent until the end of the new lease term. Depending on your situation, you may be able to avoid such a penalty.

Review your new lease agreement. The lease may contain a clause that addresses early termination. According to the University of West Florida, some landlords allow you to break a lease without facing any consequences if you give sufficient notice or follow a certain procedure. The lease may also state whether you can sublet the rental unit to a new tenant before moving out so you don't have to pay any penalty.

Notify your landlord that you wish to move out of the property. Your landlord has the option of releasing you of your rent payment liabilities, so explaining the situation may persuade her to let you go without penalties. If you are moving out because of military duties, you may be able to terminate the lease without penalty if you give a written notification 30 days before your intended move-out date. If you want to move out because the rental unit does not meet local building codes, you must give a written notification and give the landlord a chance to fix the problem before you can safely break the lease.

Advertise your rental unit in local newspapers and websites to find a new tenant to replace you if your lease allows this or your landlord agrees in writing to allow this during your negotiations. If your reason for moving out is protected by Florida laws -- for example if the rental unit is inhabitable or you need to leave for military duty -- then you don't have to find a new tenant to avoid penalty.

Talk to prospective tenants and your landlord to establish the terms of the sublease. Prepare a written agreement that details all these terms and sign it. Your landlord and the new tenant must also sign it.

Pay the landlord any penalties if you can't sublet the rental unit. You may have to pay a certain amount upon moving out or you may have to keep paying rent until the landlord finds another tenant. If you continue paying rent, the landlord has to attempt to find a new tenant to minimize your penalty. Generally, the landlord has to use at least the same amount of effort as when he initially advertised the unit before finding you.
