What Are the Rules to Get Section 8 Housing?
The United States Department of Housing and Urban Development funds the Section 8 housing program and state public housing agencies administering the program on the state level. The program helps lower-income individuals and families find affordable housing. State public-housing agencies receive the funds from the federal program and distribute vouchers to qualifying families.
Housing Vouchers
Housing vouchers allow the low-income family, elderly and disabled recipients to search for a decent, safe home in the private housing market. With a housing voucher, the Section 8 recipient can search for a suitable home on his own in an apartment or single-family home. According to the U.S. Department of Housing and Urban Development, it is the responsibility of the individual to find suitable housing from a landlord who participates in the program.
Application
Candidates for Section 8 housing must submit an application to the state public-housing agency to determine eligibility. The state agency will collect information on the individual's income, assets and the number of family members in the home. The state agency verifies the information on the application to determine if the applicant is eligible for Section 8 housing assistance.
Income
The public housing agency determines the income eligibility for the Section 8 program. According to the U.S. Department of Housing and Urban Development, families must not have an income that is more than 50 percent of the median income in the area to qualify for the program. The federal program also requires the public housing agency in all states to provide at least 75 percent of the housing vouchers to families with incomes that do not exceed 30 percent of the median income in the area.
Landlord Responsibilities
The residence must meet the state public housing agency requirements to participate in the program. When the housing voucher recipient finds a home that accepts tenants with Section 8 assistance, the public housing agency must conduct an inspection to ensure the residence meets the requirements for safety and sanitation. The agency will also determine if the amount of rent is reasonable for the rental unit.
Tenant Responsibilities
Families receiving housing vouchers must pay 30 percent of the adjusted gross income for rent and utilities. The family may choose a rental unit that is priced higher than the payment for housing, but it may not be more than 40 percent of the adjusted gross monthly income. The tenant must comply with the terms of the lease agreement and follow the rules of the state public-housing agency. In addition, the tenant must inform the public housing agency if the number of family members living in the home changes or there is a change to the amount of income the family receives.
