Reasons to Legally Break a Lease

Landlords and property managers expect you to stay in an apartment or rental property through the end of your lease. However, the reality is that there are valid reasons why you may need to vacate a property before your lease is up. Some of these reasons relate to interpersonal interactions, while others relate to life circumstances.

Job Issues

    One of the most common reasons people need to break their lease is the acquisition of a new job. In many cases, employers have to fill positions within specific time frames. Subsequently, it isn't always possible for them to wait for your lease to end before you begin work. If you don't break your lease, you may forfeit the work opportunity. Fortunately, new positions often justify paying any fees related to moving out early, and you may be able to write off expenses related to moving if your employer doesn't reimburse you.

Roommate Problems

    Another common reason people want out of a lease is that they're having issues with someone with whom they are living. Sometimes these issues are behavioral, related to property, or have to do with life circumstances, such as if your roommate suddenly decides to get married and you both decide it's best to have your own place.

Health

    Some rental properties don't accommodate medical needs well. For instance, if your complex has no stairs and your arthritis in your hip worsens, you may determine it's in your physical best interest to leave. Other facilities may provide assisted living services, even if the property is physically about the same.

Greener Pastures

    Occasionally, a person moves into a rental unit because the unit is the best they can find at the time they need to sign a lease. If a different unit becomes available, it sometimes is worth paying the buyout fee so that you can secure a rental unit that has a lower rent rate for the future, particularly if you know you'll stay at the new unit for several years. Even if it doesn't financially benefit you to break the lease, it may be better for you to do so if the new apartment has conveniences or a "feel" your current unit does not.

Landlord Issues

    Landlords are very careful about what tenants they allow into a property, but tenants have little choice about who is in control of the property they want to rent. You may be able to break your lease legally if your landlord has violated your lease in some way. Even if the courts decide you have to pay the buyout to get out of the property, sometimes it's better to part ways and eliminate the hassle the landlord creates.
