How to Break an Apartment Lease When You Lose Your Income

Breaking an apartment lease when you lose your income can prove challenging, and not every apartment landlord is understanding or sympathetic. You may initially consider walking away from the apartment without prior notice. But before harming your credit with a breach of contract, talk to your landlord to see if you can work out a deal.

    Look for loopholes in your lease. If your landlord did not fulfill his end of the agreement, you can possibly break the apartment lease without penalty. For example, did the landlord fail to make necessary repairs? Did the landlord keep the apartment in good condition? Keep records of complaints you make to your landlord and take pictures of the apartment. Use this information against your landlord if he takes you to court for breach of contract.

    Schedule a meeting to discuss your circumstances. Prior notice and an explanation of your financial situation may move a landlord to forgive the remaining lease balance and let you break a lease when you lose your income. Ask your former employer to write a letter verifying a layoff or termination.

    Notify your apartment landlord of your situation immediately, and agree to remain in the apartment until someone new moves into the unit.

    Lose your security deposit. The security deposit paid to your landlord when you signed the lease agreement is likely equal to one month's rent. Ask the landlord to keep the deposit in lieu of allowing you to break the apartment lease. Landlords may accept your offer if there's a waiting list for apartment units. Landlords can move in a new tenant quickly without losing rental income.
