Help for Disabled in Need of Housing
According to the U.S. Department of Housing and Urban Development (HUD), up to 50 percent of disabled individuals faced discrimination in 2005 in regards to rental inquiries. In an effort to assist the disabled in need of housing, HUD created programs and laws and serves as an advocate for those in need. Housing assistance and laws may vary by state and program, so those wanting to learn more about housing assistance available to the disabled should contact their local HUD or Housing Authority offices.
Federal Housing Assistance
In addition to public housing and Section 8 rental assistance, HUD's Rental Assistance for Non-Elderly Persons with Disabilities Program awards public housing authorities with funds to provide rental assistance to non-elderly individuals who are disabled. This program provides a disabled individual with a voucher to help him pay for rent at a rental property that meets his needs. The Rental Assistance for Non-Elderly Persons with Disabilities Program also helps non-elderly disabled individuals who live in a health care institution or nursing home relocate into a community that offers help with rental costs.
State Housing Assistance
With vouchers provided by HUD through the Disabled Renters' Assistance Voucher Program, local public housing authorities are able to provide more affordable rental options in apartments or rental homes. Public housing authority offices can also connect disabled individuals in need of a home with state-subsidized supportive housing rentals that provide assisted living services. States can also provide "designated housing vouchers," "mainstream program vouchers" and "certain development vouchers" to families who care for a non-elderly disabled individual. These vouchers provide families with a private rental unit, state-subsidized housing or a rental property that is generally available to only senior citizens.
Private Housing Assistance
HUD provides the owners of privately-owned rentals with tax credits if they accommodate disabled tenants with rental subsidies financed by HUD. Private housing that accepts HUD vouchers from disabled tenants can include individual apartments or congregate housing environments. While local public housing authorities can provide individuals with a list of privately-owned rental properties that cater to those who are disabled and accept HUD vouchers, these agencies do not supervise the care and services offered to tenants.
Congregate Housing Assistance
To help prevent the unnecessary institutionalization of those who are disabled, the Congregate Housing Services Program (CHSP) awards funds to public housing authorities to help individuals live a more independent life. In this program, an independent assessment committee evaluates the needs of an individual who cannot perform at least three daily living activities on her own and places her in an appropriate housing program. The CHSP provides a renter at least one meal per day in a group setting, as well as support services that help the individual live more independently. HUD pays for up to 40 percent of the support services and grantees must pay for at least 50 percent of costs. Clients pay a minimum of 10 percent for the program costs or, depending on their income level, up to 20 percent of their adjusted income.
Disabled Renter's Rights
The Fair Housing Act prohibits housing discrimination based on an individual's gender, race, national origin, religion, family status and disability. Therefore, an individual cannot have residency denied or have placing conditions on residency in public and private rental property because of his disability. Furthermore, per the Fair Housing Act, property owners must make reasonable structural modifications to a dwelling or property rules to accommodate a disabled tenant. A reasonable accommodation, for example, may include creating a disabled parking spot within the complex so a tenant can park closer to his apartment.
