Do I Have to Qualify Yearly for an Income-Restricted Apartment?
To initially qualify for an income-restricted apartment, also known as public housing, you must meet minimum and maximum income requirements. The income limits are based on the size of your household, and whether there are any senior (age 65 or older) or disabled household members. Once you've qualified for an income-restricted apartment, you must prove you still qualify at least once per year.
Public Housing
Public housing is administered locally by public housing authority offices. When you initially apply, the public housing authority office decides whether you're eligible for an income-restricted apartment. If you qualify, your rent may be income-based or you may pay a flat rent. Income-based rent is based on a percentage of your overall household income. Typically, rent is capped at 30 percent of your monthly adjusted income.
Reexamination
The process of reviewing your household's composition and income is called re-examination. Local public housing authority offices set the specific guidelines, in terms of exactly when your re-examination takes place and when you're notified about the re-examination. The Department of Housing and Urban Development requires a re-examination of household income annually if your rent is based on a percentage of your household income. HUD requires a re-examination of household income every three years if you pay a flat rent (not based on income). A re-examination of your household composition (who is living in your household) is required annually regardless of how your rent is configured.
Income
Qualifying for public housing is based on your household's adjusted income. Adjustments include deductions for each dependent, senior or disabled person and some medical deductions. Some public assistance is also excluded from being counted as annual income. If your income changes after you qualify and before your annual re-examination, you're required to report the change to your local public housing authority office.
Disqualifying
If your income has increased, your household size decreased or changed significantly or a combination of the two, it's possible to no longer qualify for income-restricted housing. You won't be forced to move, though, unless there is affordable housing available for you and your family. You can also be disqualified from public housing for not complying with the lease. Review your lease carefully so you and your household remain in compliance.
