Why Is Subletting Bad?

If you're planning time away from your leased or rented home, but still plan to return to it and keep it as your residence, subletting is an option you might want to consider. Subletting is the process of renting your apartment out to a sub-tenant, who will pay the rent while you're gone. Because the lease is still in your name, there are some definite risks involved.

Damaged Apartment

Unless you are very familiar with the person to whom you sublet, it's impossible to tell if he will damage your belongings, or worse --- the apartment or home. If you place an ad on a social media or classified website, your prospective renter can be a virtual stranger who may, or may not, keep the place in the condition you require. If you have a dispute with the sub-tenant while you are still away, the sub-tenant may damage the apartment out of spite. If the sub-tenant is careless or lazy, the place can get very dirty. Cleaning the place after the sub-tenant moves out may not be so bad; but if you have to pay for damages to flooring, walls, appliances or other fixtures that belong to the landlord, the sublet process can be quite expensive and not worth it in the long run. Your name is still on the lease and you are ultimately responsible.

Missed Rent

Non-payment of rent is an issue that could adversely affect your finances. If the sub-tenant misses the rent payment, you must come up with the rent for the original apartment and, if you are renting another place, the rent for that as well. If you are unaware that the rent has not been paid, your landlord can attach late fees to your rent. Depending upon the state or the lease agreement you have with the owner, rent may be late after the 5th day of the month. If your sub-tenant misses the rent completely, not only can you be reported to credit bureaus and your credit scare affected, you can face eviction if the rent is not brought up to date. The landlord can sue you for back rent and all legal fees plus punitive damages, which may be three times the amount of the missed rent.

Theft of Personal Belongings

Most tenants sublet their apartments fully furnished --- that's what makes it so convenient for both tenant and sub-tenant. Personal belongings may be stolen from your apartment while you're gone. Worse, you may not notice what's missing for quite some time after your return. You can minimize losses from theft by renting a storage unit in a secure facility and keeping your belongings there until you return. Keep in mind that the cost of the storage unit might make subletting cost prohibitive in the long run.

Neighbor Discord

Your neighbors could be adversely affected by sub-tenants who have no desire to hold down party noise, pick up trash or refrain from rude or illegal activity. If you have a good relationship with your neighbors, the sub-tenant could effectively destroy it during his tenancy.

Considerations

The sub-tenant and the landlord typically have no relationship, so damages sustained to the rental unit are your legal obligation to rectify. In some instances, it is a violation of the lease agreement to sublet your apartment; you could be out of your apartment permanently if the lease prohibits subletting. It is the right of the landlord to know who the tenant is. Check your lease before you sublet and get your landlord's consent. Write a sublease agreement with your sub-tenant so that you have your terms in writing.
