The Early Termination of a Rental Agreement

Early termination of a rental agreement is a breach of contract, and your landlord has the right to take legal action to recover lost income. However, circumstances such as job loss, relocation and divorce may justify early termination of a rental agreement. Talk with your landlord in advance to see if you can work out an agreement to avoid the consequences.

Simply Ask

    Explaining your situation to your landlord may persuade him to allow early termination without penalty. Schedule a face-to-face meeting with your landlord. Dress in business casual attire to make a good impression. Discuss the details of your situation and explain that you're unable to fulfill your rental agreement, but you would like to leave on good terms and avoid legal recourse. Depending on your past rental history --- for example, whether you've always paid on time --- your landlord may agree to terminate the lease early. However, he is not obligated to grant your request.

Pay Off Lease

    If you only have a few months remaining on your lease agreement, speak with your landlord to see if paying off the lease balance is an option to terminate the agreement early. This option works only if you have disposable income to provide your landlord with a lump sum. If your landlord agrees to the arrangement, get everything in writing to protect yourself if the landlord takes legal action.

Stay Until Landlord Finds New Tenants

    Propose staying in the apartment or house and paying rent until your landlord is able to find new tenants for the residence. This method benefits landlords, because they don't lose income on the property. Speed the tenant search by working with your landlord and asking around to see if friends or relatives are looking for a place to rent. The quicker your landlord secures a tenant for the residence, the quicker you can move out.

Sublease

    As a last resort, asking a trust friend or relative to move into your apartment and make the monthly rent payment is another option to get from under a rental agreement. Be aware that your name remains on the lease agreement, and you're still responsible for the monthly lease payment. However, subleasing works if you can no longer afford the rent on an apartment or house and don't want to risk credit damage. The person leasing the residence can send rent payments to you, and you in turn forward payments to the landlord. Read your rental agreement carefully to see if your landlord permits subleasing.
