Section 8 Tenant Penalties
The Housing Choice Voucher program, or Section 8, helps low-income families pay rental expenses for suitable housing. Tenants that earn less than 185 percent of the federal poverty level receive the monthly subsidy. Because the program focuses on income, the harshest penalties involve income fraud. But the program also imposes penalties for various violations such as general landlord-tenant regulations.
General Penalties
Tenants receiving a Section 8 subsidy are subject to the penalties imposed by the landlord-tenant law in their state. General penalties include eviction, judgment for abandonment and late payment penalties. Extended absences from a unit, up to 180 days, can result in termination of assistance by the housing authority. However, there may be exceptions for tenants with a medical emergency who can provide documentation that substantiates the absence.
Transfer Denial
The housing authority may deny tenants who wish to transfer to a new property if the tenant does not meet the minimum transfer standards. Tenants must complete a porting process to initiate a transfer. The process requires the payment of utility bills, submission of a notice to vacate and leaving the current residence in the appropriate condition. In the event a tenant does not meet these expectations, they are denied the ability to move.
Fraud
Section 8 fraud occurs when a tenant does not fully disclose her income or family composition to the public housing authority. A tenant can be penalized if the tenant earns more than reported or has additional people with incomes above the guidelines residing in the home. Penalties for Section 8 fraud vary from state to state, but many impose a 10 year prison sentence for offenses such as theft of public funds or intentionally providing false information. Furthermore, the housing authority can require tenants to repay excess rental fees paid on behalf of the tenant.
Termination
Tenants can lose their voucher for a number of reasons. Violations of family obligations, a previous eviction from federally funded housing, drug abuse or breaking a repayment agreement with the housing authority can result in termination of the subsidy.
