Landlord's Responsibilities When Renting a Home

On the whole, a landlord's responsibilities when renting a home are directed by the state laws where the rental property is located. All states have statutes specific to the rights and responsibilities of landlords and tenants. As a new landlord, you should become familiar with your particular state's laws before signing your first lease agreement with a tenant.

Maintenance and Repairs

    In most states, there is an implied warranty of habitability that exists for tenants when renting a home. As a landlord, this means it is your responsibility to ensure your rental property is safe and livable for tenants. A landlord's responsibilities when renting a home generally include timely repairs of issues that could affect the habitability of the home, such as a leaky roof, inadequate heating and cooling, faulty plumbing and electrical systems and unsound flooring or stairs. Whether you or the tenant will take responsibility for repairs and maintenance due to the day-to-day use of the property, such as yard care, leaky faucets and paying for utilities, should be clearly outlined in the lease agreement.

Safety and Security

    It is also your duty to take reasonable measures to protect your tenants from possible theft, vandalism or other criminal conduct perpetrated by third parties. Reasonable measures include, but are not limited to, the installation and proper maintenance of locks, security cameras and so forth. If you have an alarm system installed on your rental property, it must be in working order, or you could be liable for damages suffered by the tenant resulting from a faulty alarm system. There are state laws and usually local building codes that set the standards for the qualifications, installation and repair of smoke-detector alarms. You will be liable for any tenant damages arising from your concealment of any dangerous conditions existing on the property, at the signing of the lease or for failure or negligence in making any necessary repairs.

Rental Walk-Through

    A landlord's responsibilities when renting a home include the return of any unused security deposit monies to the tenant. You need to include a detailed list of any deductions you made to complete tasks required to bring the property back to move-in condition for the next renter. Although it may not be required by state law, it is always a wise idea to perform a walk-through with a tenant prior to signing the lease. A detailed listing of any pre-existing defects, such as carpet stains, missing appliance parts and so forth, will protect you and the tenant when the tenant vacates the property. Typically, any unused portion of a security deposit must be refunded to the tenant within 30 days of the lease ending.

Property Insurance

    Properly insuring a rental property against potential losses due to fire, floods and other natural disasters is the landlord's responsibility when renting a home. Losses of personal property by the tenant due to burglary or the tenant's own negligence --- if he left a door or window unlocked, for example --- are covered under renter's insurance, which is not your responsibility as a landlord. However, you could be liable if the burglary was aided by inefficient or missing locks on the property.
