Landlord and Tenant Laws in Missouri
When landlords and tenants enter into rental or lease agreements in Missouri they must follow laws established by state courts. The laws cover items like security deposits, safe dwellings, collecting rent and evictions. Understanding the landlord and tenant laws can help Missouri residents get the benefits they are legally entitled to when they rent apartments and houses.
Lease Agreements
Tenants are held responsible for conditions and terms outlined in lease agreements they sign. For this reason, tenants are encouraged to read through lease agreements before signing. Also, tenants have the right to ask landlords to make changes to lease agreements before they sign them. Basic items that are required on lease agreements are the landlord's name and address, amount of rent and date due, the length of the lease and the amount of the security deposit.
Security Deposit
The maximum security deposit amount a landlord in Missouri can ask for is equal to two months' rent. Landlords must return security deposits to tenants within 30 days after tenants vacate the premises. A part or all of a security deposit can be retained to pay for damages that a tenant willfully caused to the property or to pay for late rent. If a landlord deducts money from a tenant's security deposit, he must list the damages that were caused and the amount to repair the damages and send the list to the tenant at the tenant's new address. Tenants are not allowed to use their security deposit to pay the last month's rent. They are, however, allowed to walk through the vacated unit when landlords do a final inspection.
Evictions
Landlords can evict tenants if they fail to pay their rent. They can also evict tenants if they willfully damage the property, injure another tenant, allow people to conduct drug-related activity on the property, conduct illegal gambling on the property or violate other terms of the lease agreement. Before landlords evict tenants they must obtain a court order to have the tenant removed from the property.
Safe Dwellings
Tenants have a right to live in safe and sanitary rental units. Landlords must make repairs to appliances and other rental equipment like kitchen sinks and bathroom plumbing as needed. It is the landlord's responsibility to pay for all necessary repairs, unless the tenant caused the damages intentionally.
Discrimination
It is illegal for Missouri landlords to refuse to rent property to a person based on the person's race, color, religion, sex, nationality or disability. Landlords are also prohibited from charging some tenants higher rents based on the above attributes.
