If I Have Burglary on My Record Can I Get a Job in Another State?

With numerous applicants competing for a single position, employers are often selective as to whom they hire. After narrowing potential candidates, background checks are usually conducted in the final part of the hiring process. If you have a burglary on your record and move to another state, today's technology makes it nearly impossible to hide it from an employer.

State Background Check

    Your employer may choose to perform a state check. In a state background check, criminal records for each county you lived in, worked in or attended school in for the past seven years will be visible. If the potential employer opts only for a state background check, the burglary may not be detected. A Social Security number scan will show prior addresses associated with your number. A recent move may prompt the employer to conduct a national or interstate background check.

National Background Check

    Employers may choose to run a national background check on applicants. A national background check compiles information reported from all state and federal agencies. If you are charged with a burglary in any state, the charge or conviction will appear on your record in a national search. If you are applying for a government job or contracted employment through a government agency or working with children, a background check will be performed through the National Crime Information Center system using your fingerprints.

Felony Convictions

    In most states, burglary is a felony charge. Breaking and entering, however, may be classified as a misdemeanor. On a standard job application, you will be asked if you have ever been convicted of a felony. You are expected to be honest on your application and report the truth. If you have been convicted, be honest with the employer. A felony does not necessarily disqualify you from a job.

Expungement

    You may be able to request the court to expunge or seal your record if you are a first-time offender. An expungment is a type of lawsuit. State laws vary on the type of crimes that can be expunged. If your record is expunged, it cannot be accessed in an employment background check.
