How to Write a Joint Letter for Breaking a Lease
A joint letter for breaking a lease informs your landlord that you and your roommate are moving out of your home or apartment before the lease expires. The letter acknowledges that you two are breaking the lease, but it does not relieve financial responsibility for making rent payments as agreed. What happens after you write the letter depends on the lease agreement, which is a legal document, and how the landlord proceeds. There is a chance the landlord will let you and your roommate out of the lease with minimal penalty if there is a waiting list for the property.

Review the reason for breaking the lease with your roommate. You two may simply want to live somewhere else, or you have decided to part ways. Read the terms and conditions of the lease to determine if there is a clause allowing you out of the lease without penalty, or by paying an early termination fee.
2Visit with a real estate attorney if there isn't a clause allowing an easy out, or if you feel you should not pay an early termination clause. For example, you may feel the landlord failed to live up to his responsibilities by not making repairs in a timely way. Ask the attorney if you have legal grounds for breaking the lease under those conditions.
3Write the letter using a friendly but professional tone. Tell the landlord that you and your roommate are moving out. List the date you are leaving the premises.
4Address the lease agreement in the next paragraph. Tell the landlord that you and your roommate will pay the early termination fee as listed in the agreement, if that is the case. Or choose other options. Tell the landlord, for example, that your attorney advises that the landlord has violated the lease and you are breaking the lease as a result. Or leave the lease as an open issue by telling the landlord that you look forward to "mutually beneficial discussions" for the early termination.
5Sign the letter and have your roommate sign it before delivering or mailing it to the landlord.
