How to Break a Lease Due to Job Change
Job relocation may promise an increase in income, new perks or professional accomplishment -- but breaking your lease can cause substantial financial strain. There is a way to approach an early lease termination that minimizes the financial burden. Communication, honesty and an understanding of state landlord and tenant law only help the lessee, because ultimately, the outcome is controlled by the lessor.

Read through your lease carefully and pay close attention to clauses regarding "early termination." In the absence of such clauses, review the lease for language related to your deposit, automatic contract renewals and fees. The absence of an early termination clause does not mean you can simply vacate -- it means you should negotiate with your landlord.
2Locate your state's landlord and tenant code to determine permissible causes for early termination. One of the only groups covered for early termination by law is military service members.
3Contact your landlord and explain your situation. Leases that restrict early termination and states that do not allow job relocation as a permissible termination cause require communication. Tell your landlord about the benefits of your relocation and negotiate a settlement. You may incur substantial fees, and an unreasonable landlord can sue you for abandoning your lease.
4Contact potential tenants to lessen the financial impact. Many states allow landlords to collect rental fees for the amount of time it takes to establish a new lease. For example, if a tenant terminates early and it takes the landlord two months to locate a new tenant, the original tenant is required to pay rental fees for two months. If you can locate a suitable tenant, make arrangements to create a new contract and successfully complete the transfer, you should receive your deposit and avoid substantial fees. You can also sublet the unit as long as the lease does not prohibit subleasing.
5Write a letter to your landlord outlining the date you will move, your reason for early termination, as discussed, and request a walk-through of the unit. Make sure your letter details your discussion in case you need supporting documentation in the future. If you located a new tenant, complete this step anyway to maximize your return deposit. If not, request an itemized list of deductions from your deposit from your landlord.
6Complete your end of the obligation regardless of the outcome. This will help you avoid court-ordered payment, which can damage your credit and rental history.
