Do Renters Have to Pay for Carpets?

While you do not own your home, as a renter you have a responsibility to treat the property like your own. This includes keeping your rental clean and not doing any damage to the property while you live there, such as staining the carpet. Most landlords require a security deposit to protect themselves if you do cause damage. However, the landlord must separate normal wear and tear from damages when he returns your security deposit.

Security Deposits

    Landlords who require that you provide a security deposit before you move in hold the deposit in an account until you move out. When you move out, the landlord should refund you the amount of the deposit, less the cost of repairing any damages you made to the rental unit, including damages to the doorways, walls, carpeting or appliances and fixtures. The landlord cannot deduct the cost of normal wear and tear to the interior or exterior of the property.

Normal Wear and Tear

    In most states, landlord and tenant laws do not allow landlords to consider normal wear and tear to the property as damage. Normal wear and tear consists of any minor defects that happen inside homes as a result of people living there. For example, carpeting can become worn in high traffic areas by doorways and through hallways. The carpeting may also mat or fray around the corners after several years of use. The landlord cannot take the cost of repairing normal wear and tear out of your security deposit.

Damages

    The landlord can deduct the cost of repairing damages you caused in your rental. For example, if you spill red wine on the living room carpet, the landlord can deduct the cost of hiring a professional cleaner to remove the stain. If your pet tears up the carpet in the bedroom, the landlord can deduct the cost of replacing the carpet in that room. The landlord can charge you only a reasonable amount, and only for the damages you caused. He cannot charge for preexisting damages.

Tips

    Normal wear and tear is a vague term and can cause disagreement between you and your landlord when it comes time to return the security deposit. To avoid this, take photos of the carpeting in every room the day you move in, especially if you notice any stains or damage. When you move out, vacuum the carpets carefully. If you notice any stains, do your best to remove them. After you move out, return to the property and take photos of the carpet. Use these photos to dispute any unfair claims the landlord makes to your security deposit.
