Can Rent on a House Be Deducted in Federal Tax Calculations?
Working from home has numerous benefits, aside from getting to work in your sweats and eliminating the daily traffic grind. Renters who work at a home-based business in their apartment or home can enjoy certain tax breaks most of the same tax deductions as a homeowner, with a few exceptions. Before you deduct your rent as an expense, the Internal Revenue Service (IRS) requires that your home-based business meet certain tests.
No Deduction For Personal Use
The IRS does not allow a deduction for normal rent payments; rent is a regular cost-of-living expense with no tax benefit. This applies to an apartment, condominium, town home, single family home, mobile home, boat or vacation home you rent for personal use. The IRS does allow for a deduction, however, for a qualified home office located in your rental.
Home Office Deduction
As long as a part of the taxpayer's residence is used exclusively and regularly for business, the IRS permits a deduction for part of your rent on your income tax return. The room or area you use must be the principal place of business; if you use the room for purposes other than business, the deduction is not allowed. The IRS is very strict on this rule with a zero-tolerance policy; even minimal non-business use will disqualify the rent for a deduction, according to author James O. Parker.
Definition of Office
If you set up a home office in your apartment, it does not need to be a separate room of your residence. A cubbyhole, a partitioned area, a portion of your garage or a full bedroom will qualify as your home office as long as it is devoted exclusively to business. Your home office should be a place where you meet clients, patients or customers or store inventory or samples.
Determine Your Rent Deduction
You must calculate your deduction by determining the percentage of the rental that comprises the office space. If your apartment is 1,000 square feet and your office space is 100 square feet, you may deduct 10 percent of your rent, in addition to your equipment, office supplies, utilities and other business expenses. Simply divide the square footage of your office by the total square footage of your apartment.
