If you have a growing mold problem in your kitchen or bathroom, and the landlord will not take the steps necessary to remove the mold, you may want to move from your apartment. You can leave your apartment at any point during the last month of your tenancy, provided you gave the landlord proper written notice. If you fail to notify the landlord, you may face fines.

Lease Agreements

    Your lease agreement should state when and how you can end your tenancy without paying a penalty. For example, your landlord may require that you provide a 30-day notice before leaving the property. If you do not provide this notice and the lease term ends, your lease may renew automatically on a month-to-month basis. The specific terms will depend on the rental laws in your state and your landlord's personal preference.

Termination Etiquette

    Notify your landlord in writing that you plan to end your tenancy, even if your lease is up. Include a reason in your letter to the landlord, specifically the mold problem in the apartment. Fees

Considerations

    The landlord may try to blame you for the mold problem in the apartment. To combat this, keep a copy of any correspondence between you and the landlord. If the landlord keeps your security deposit, you can file a suit against him in a small claims court. Having this documentation will help your case. You can also take pictures of the mold problem. Any pictures should have a time stamp on them.
