What Are the Requirements for Putting Your House on a Section 8?
Qualifying your property for Section 8 of the United States Housing Act means that you can increase your prospective tenant base. If you meet all of the requirements, then you can market your rental to traditional tenants and those who are eligible to receive public assistance to make their rent payments. However, your property will need to meet certain criteria before it is approved to be placed on the list of rentals available to Section 8 tenants.
Purpose
The Housing Choice Voucher Program, referred to as Section 8, is administered by your local public housing authority, or PHA, under funding from the U.S. Housing and Urban Development Department. The program helps very low income families live in safe and secure housing. If applicants qualify, the PHA determines their need and pays that portion toward their rent. The balance comes from the tenant. If you qualify to rent under Section 8, you will receive regular payments for the government subsidy.
Physical Requirements
To be approved, your rental will have to meet certain health and safety standards. The dwelling must have at least one bathroom and a kitchen with storage, food preparation area, heating element and refrigerator. The bedroom may be separate or a combination with the required living room. Each room must have a window. Plumbing and heating systems must be in working order. All windows need screens and you have to be able to lock them.
Rental Requirements
You may advertise and screen your tenants the same as you do for traditional renters. You should check a rental applicant's tenant history, such as payment of rent and utilities, upkeep of the unit previously occupied, disturbance of neighbor complaints, drug-related or other criminal activity and meeting all the clauses of the lease. The PHA may provide some of this information to you, if it is kept on file. The lease is held by the tenant, but you must use a HUD addendum with your own form or the PHA standard lease format. As in all rental applicant screening, you may not discriminate against a prospective tenant due to race, color, national origin, disability, sex, religion, age or family status.
Considerations
Allowing Section 8 tenants guarantees regular payments from the government and, if your tenant is content with the rental, you may have a long-term occupant, which saves you money in turnover and vacancies. Your PHA may require routine annual inspections, which ensures that your property is kept current and all systems are operable. Also, you may end the tenancy of a Section 8 tenant only under significant violation of lease clauses, such as non-payment of rent, breaking the law or disturbing the neighbors. If your PHA fails to pay the portion of the rent agreed upon, it does not constitute a violation of the lease by the tenant, and you may not evict for that reason.
