The Landlord-Tenant Relationship Act in South Carolina

Whether you manage the apartment or rent it, you have rights under the law. The South Carolina Landlord and Tenant Act creates a guideline for landlords and tenants to follow. Under the Act, both parties have special rights provided they live up to their obligations. These rights protect landlords from losing money and protect tenants from unfair evictions.

Fees

    The landlord can charge the tenant rent. The landlord must list the rent fee in the lease agreement. The landlord can charge the tenant a security deposit before moving in. When the tenant vacates the property, the landlord can deduct any unpaid rent or the cost of repairing damages from the security deposit. The landlord must return the remainder of the security deposit to the tenant within 30 days. According to the Landlord and Tenant Act, if the landlord does not return the deposit, the tenant can sue the landlord for up to three times the amount of money owed plus attorney fees.

Landlord Obligations

    The landlord must maintain the property. This includes keeping all common areas in a clean, safe condition. The landlord must make necessary repairs to the rental unit itself when requested by the tenant. This includes repairs to plumbing, electrical wiring, ventilation, air conditioning systems and any appliances provided by the landlord. If stated in the lease, the landlord can enter the property without warning to make repairs or inspections between the hours of 9 a.m. and 6 p.m. Otherwise, the landlord must give the tenant a 24-hour notice.

Tenant Obligations

    The tenant must follow any provision stated in the lease. The tenant must keep his rental unit in a livable condition. This includes placing trash in outside trash bins, keeping the property clean and keeping the plumbing, fixtures and appliances in good condition. The tenant cannot cause any damage to the property beyond normal wear and tear. These regulations also apply to guests of the tenant.

Evictions

    The landlord can evict the tenant for violating the lease as long as the landlord gives the tenant proper notice. RentLaw.com reports that the landlord must give the tenant a five-day written notice if the tenant does not pay her rent. If the tenant does not pay the rent within this time period, the landlord can file for an eviction. If the tenant violates any other term of the lease agreement, the landlord must give the tenant a 14-day written notice. If the tenant corrects the problem within the 14-day period, the landlord cannot file for an eviction.
