Tenants' Expenses When Breaking a Lease in Washington State
As a renter, you have a lease with your landlord. Your lease states the amount of time you agree to live at the rental property. To move out early, you'll have to break the lease, which can result in fines. Washington state law designates what term and month-to-month tenants must pay for breaking a lease.
Breaking a Lease
By signing a lease, you enter into a legally binding contract with your landlord. Part of that contract states that you will live at a property and pay rent for a certain amount of time. You can break your lease and move out early for any reason, such as a job transfer. To do so, you will need to notify your landlord in writing as soon as possible and arrange to pay any fees.
Term Tenants
Term tenants have a lease that typically lasts for a year or less. By signing the lease, the tenant agrees to remain at the property and pay rent for the full term. If the tenant breaks the lease, he may have to pay for the remaining rent due through the rest of the term or pay rent until the landlord can rent the property to a new tenant. The tenant may also have to pay the landlord's expenses and any attorney's fees the landlord accrued while taking possession of the property and renting it to a new tenant.
Month-to-Month Tenants
A month-to-month tenant does not live at a rental property for a specific period of time. However, the tenant must give the landlord proper notice before moving out. If the tenant does not give proper notice, she may have to pay a fee to the landlord. The University of Washington's Office of Off-Campus Housing Affairs reports that a month-to-month tenant may have to pay rent for an additional 30 days if he breaks the lease.
Exceptions
Tenants in the military or tenants who have a spouse in the military can break their lease without paying any fees to the landlord in some cases. If the tenant or spouse receives a deployment order or a reassignment order, he can break his lease. However, he must notify the landlord within seven days of receiving notice, according to state law.
