If a Landlord Accepts Section 8 From One Tenant, Can He Refuse Section 8 From Another Tenant?

Landlords who register to accept Section 8 tenants must meet certain basic standards. Once they have been approved to accept Section 8, they cannot then discriminate against a prospective tenant solely because the applicant has a housing voucher. However, the landlord can screen tenants and reject them for other reasons.

Approval

    Landlords who want to rent to Section 8 tenants must first have their rental premises inspected by the local public housing agency which administers the Section 8 program. The unit must be safe and habitable. The landlord must be prepared to offer a year-long lease and must not charge more than a fair market rent. The PHA will help a landlord who meets these standards by advertising his units for free to Section 8 tenants.

Discrimination

    It is an offense to refuse a potential tenant solely because he has a Section 8 voucher. If there is a choice between two tenants, one with a voucher and one who will pay the full rent by himself, the landlord must not discriminate on the basis of the voucher.

Screening

    The PHA does not screen Section 8 rental applicants. It is the landlord's responsibility to run credit checks, criminal background checks and take references. If negative information about the person applying for a rental unit is acquired, the landlord can refuse to rent to them on the basis of that information, even if they have a Section 8 voucher. This applies even if there are other tenants who are using Section 8 vouchers.

Action

    Those who have a Section 8 voucher and who believe a prospective landlord has discriminated against them on the basis of Section 8 status should contact their local public housing agency and should write down exactly what happened when the discrimination occurred. The PHA will provide information on how to file a complaint against the landlord.
