HUD & Section 8 Housing
The U.S. Department of Housing and Urban Development provides rental subsidies to low-income families to make their rent more affordable. This rental subsidy, called Section 8, is administered through local housing authorities. HUD's goal for this program is to ensure low-income families, seniors and people with disabilities have access to safe and decent housing options. Families can receive a rental subsidy for as long as they meet the eligibility requirements. Many affordable housing complexes also provide supportive services such as a meal program, child care or transportation services.
Program Overview
HUD has two Section 8 rental subsidy programs. The Public Housing program provides a rental subsidy to tenants that live in a federally subsidized housing unit. The Section 8 Housing Choice Voucher Program provides a rental subsidy for any conventional housing unit as long as the landlord agrees to accept a voucher as a form of payment. Both programs allow the family to pay 30 percent of its income toward rent. HUD pays the remaining portion of rent directly to the property owner.
Who Qualifies for Help
The family's income cannot generally exceed 80 percent of the area median income. HUD requires that housing administrator allow families with income in the extremely low-income limit level, or 30 percent of the area median income, be given a priority. These families will be admitted into the program before families with higher income levels. All household members over the age of 18 will be screened for drug-related criminal activity and lifetime sex offender registration. Any family member who has been evicted from federally assisted housing for drug-related activity within three years before submitting an application will be denied admittance. All family members must be U.S. citizens or eligible non-citizens to receive the maximum subsidy amount.
Application Process
Contact the local housing authority to find out how to apply for a rental subsidy. Since funding is limited, you may be placed on a waiting list. Once you have completed your application, you must be able to provide documentation of identity, income and citizenship status for you and all other household members. You will also be required to provide your Social Security number for criminal screening. You will be admitted into the program if you qualify for a rental subsidy and the housing complex has units that can accommodate the size of your family.
Leasing Requirements
You will be provided with a HUD Model lease once you have been selected to move into the unit. The lease requires that you certify your total household income on an annual basis. This ensures that you are paying the correct rent if your income should adjust. The lease also requires that you allow an annual inspection of your unit. Once you decide to vacate the unit, any security deposit that was collected must be refunded. If there is damage to the property, the housing administrator can deduct the costs to repair the damage, but must provide you an itemized list of all the expenses. You must provide a forwarding address to get the refund of your security deposit. The deposit must be refunded within 30 days of move-out or in accordance with state laws, whichever option has the most benefit for the tenant.
