Can I Qualify to Rent an Apartment With a Broken Lease?

A broken lease can impede future apartment rentals. Breaking a lease indicates that you're likely to not fulfill the rent contract. This can make landlords nervous and unwilling to accept you as a tenant. But even if you have a broken lease in your past, you can convince a landlord to work with you.

Be Upfront

    The landlord will check your credit history. If a previous landlord took you to court for breaking a lease and won a judgment against you, expect your new landlord to see this information on your credit report. Warn potential landlords of your past rental problems before submitting your application. Mention that you broke a lease and provide a good explanation. Perhaps you lost your job and couldn't afford the lease payment, or maybe you became ill and couldn't work. Knowing the circumstances behind the broken lease can work in your favor.

Rental Cosigners

    Qualifying for an apartment after breaking a lease might require a cosigner. This person functions as a joint applicant, and landlords take the cosigner's credit history into account when approving the application. You're the primary tenant and signer on the application, but your cosigner is the person who shoulders the burden of paying the rent if you break the lease and stop paying. Landlords can legally sue you and/or your cosigner if they do not receive rent payments as agreed upon.

Provide Income

    The ability to provide landlords with income and employment information might improve your approval chances after breaking a lease. If you broke a past lease due to economic hardship, the fact that you now earn a steady paycheck and have been consistently employed may help you qualify. Discuss income and employment requirements with your landlord, and then provide documents to confirm your salary and length of employment. This can include copies of paychecks, yearly tax returns or bank statements.

Considerations

    The fact that you've broken a lease is enough to turn off some landlords. However, broken contracts that result in a credit judgment only remain on your credit report for seven years, and the damage lessens with time. In the meantime, negotiate with landlords to help you get a rental. For example, you can propose a month-to-month rent agreement and then agree to pay a higher rent to compensate for your past rental issues. With a month-to-month agreement, you can usually break your least at any time with 30 days notice.
