Addendum Laws on a Lease Renewal in Texas
When a tenant moves into a rental property, he signs lease agreement with the landlord. The lease agreement states how long the tenant will remain at the property, such as month to month or one year. At the end of the lease term, the landlord can decide to end the agreement and ask the tenant to move, or offer to renew the lease. Texas landlord and tenant laws dictate how much notice the landlord must give the tenant, as well as how the tenant must respond.
Notice From the Landlord
According to Texas law, if the landlord does not want the tenant to remain at the rental property, he must send the tenant a notice to vacate explaining that he will not extend the lease for another term. If the landlord does want the tenant to remain, he must send the tenant an offer of lease renewal. Onecle, a law and legal research website, reports the landlord must send these notices to the tenant no later than 60 days before the current lease expires.
Changes to Lease Terms
The landlord must honor the lease terms through the current lease period. If the landlord offers a lease renewal, she can change the terms of the lease. For example, the landlord can increase the monthly rent to a reasonable amount. If the tenant agrees, he will start paying the higher amount starting the first month of the lease renewal. The landlord must include any changes to the lease in writing with the option to renew.
Tenant's Response
The tenant must decide whether or not to accept any new terms and continue the lease, or to vacate the property. Per Texas Law, the tenant must respond to the landlord in writing within 30 days of receiving notice from the landlord, according to Onecle. Once the tenant responds, the landlord can add a lease renewal addendum to the current lease. The landlord must include any changes made to the lease in writing and provide a tenant with a copy of the renewal addendum.
Considerations
If the tenant wishes to remain at the property, but cannot afford a rent increase, he can try to negotiate with the landlord. If the landlord agrees to lower the rent increase, he should say so in writing. If the tenant does not get a written letter of this agreement, the landlord could charge the higher rent rate when the lease renews.
